FIDIC DAB to DAAB: The Dispute Path 1999 vs 2017, Engineer’s determination, NODs, board referral, decision, arbitration under Red, Yellow and Silver Books 1999 and 2017.
Course Description
This course contains the use of artificial intelligence.
A claim has been rejected. What happens next is not a matter of opinion: it is a path with fixed steps and fixed clocks. Take a step late, or in the wrong order, and you can lose the right to challenge at all.
This course walks the whole dispute path under the FIDIC Red Book 1999 (Dispute Adjudication Board) and the Red Book 2017 (Dispute Avoidance/Adjudication Board), side by side, and flags where FIDIC’s 2022 reprint of the 2017 text changes the wording. The course follows the Red Book 1999 and 2017, and includes a comparison of how the board is appointed under the Red, Yellow and Silver Books.
What you will be able to do:
- Tell a claim from a Dispute under each edition and print
- Follow the Engineer’s determination under 1999 Sub-Clause 3.5 and 2017 Sub-Clause 3.7, including time limits and deemed rejection
- Give a complete Notice of Dissatisfaction on time, and refer within the 2017 42-day window
- Form the board, refer a Dispute correctly, and act on the decision and its payment effect
- Use amicable settlement, start arbitration on time, and enforce decisions
- Use the 2017 DAAB to avoid disputes, not just decide them
Why this course is different:
- Built around one dispute path, from the Engineer’s determination to arbitration, rather than a book-by-book read-through
- 1999 and 2017 compared step by step, with the 2022 reprint changes flagged where they matter
- Worked dates on a fictional project, with pause-and-decide exercises in every lecture
- A downloadable Quick Reference timeline for both editions
- Short: about 43 minutes of focused video
